“To ask the Chief Executive why no planning permission was required for the
replacement of Eircom phone boxes with an advertising panel/phone booth given
that the new units are larger than the old boxes?”
Reply:
While no specific site details have been provided, certain works by statutory
undertakers are exempt development under Class 31.
Class 31 (c) of the Planning and Development Regulations 2001, as amended, states,
The carrying out by a statutory undertaker authorised to provide a
telecommunications service of development consisting of the provision of – telephone
kiosks or other telephone facilities in a public place not being on, over or along a
public road. No such kiosk or facility shall be situated
within 10 metres of the curtilage of any house, save with the consent in writing of
the owner or occupier thereof.
